Dear Colleague

WATER ACT 2003: WATER SUPPLY LICENSING

CONSULTATION ON POLICY PROPOSALS TO MODIFY WATER UNDERTAKERS' CONDITIONS OF APPOINTMENT AND DEVELOP LICENCE CONDITIONS FOR WATER SUPPLY LICENSEES

The water supply licensing provisions (the licensing provisions) in the Water Act 2003 amend the Water Industry Act 1991 to extend the opportunities for competition in the water industry in England and Wales. From autumn 2005, non-household customers who are likely to use at least 50 megalitres of water a year will have the option of switching from their existing water undertaker to a water supply licensee.

In order to ensure water undertakers and water supply licensees are able to operate under the licensing provisions, we need to modify water undertakers' conditions of appointment and develop licence conditions for water supply licensees. These are central to the successful implementation of the new competitive regime.

The attached consultation paper sets out our proposals, on which we invite your comments by 21 May 2004. Please send your comments to Sukvinder Khangure, Office of Water Services, Centre City Tower, 7 Hill Street, Birmingham, B5 4UA or by e-mail to: sukvinder.khangure@ofwat.gsi.gov.uk

Unless otherwise requested, all responses will be placed in the Ofwat library and made available to the public.

Following consideration of the responses, we will consult again later this year on the draft legal text of the licence conditions and proposed modifications to conditions of appointment.

Yours sincerely

Tony Smith
Director of Competition and Consumer Affairs
