OFWAT REPORTS ON COMPETITION COMPLAINTS |
Ofwat today published its second annual report on the complaints it has considered under the Competition Act 1998 (the Act).
Between April 2002 and March 2003, Ofwat received 13 complaints under the Act. The complaints covered issues such as tankered waste, common carriage and retail competition in the water industry.
The report, 'Complaints considered under the Competition Act 1998', tells companies, individuals and organisations representing customers about:
- types of behaviour that have resulted in complaints under the Act
- case studies of some of the complaints and how Ofwat has handled them; and
- policies Ofwat has developed to facilitate the competitive environment.
Beryl Brown, Head of Ofwat's Competition Policy Team said, "Since the Act was introduced in March 2000 we have taken a proactive approach by developing policies to encourage competition. We have issued guidance on competition in mains laying (self-lay) and the shared use of networks by other suppliers (common carriage).
"The report details the various issues raised in complaints under the Act and shows the different steps we have taken to resolve them."

1. The Director General of Water Services is the economic regulator of the water and sewerage companies in England and Wales. He exercises his powers in a way that he judges will allow them to carry out their functions properly, and finance them. Customers' interests are represented by WaterVoice.

3. The Competition Act 1998 came into force on 1 March 2000. It gives the Director General of Water Services concurrent powers with the Office of Fair Trading to apply the Competition Act 1998 for the water and sewerage industries.
