WATER SUPPLY LICENSING REGIME
We recently issued our guidance on access codes and our access code template, under cover of WSL 03/05 and 04/05. Because letters in the 'WSL' series go to a wider audience, I am writing to draw your attention to this guidance, which requires action to specific deadlines from incumbent companies.
MD201, dated 28 February 2005, reminded you that the new statutory regime for market competition under the Water Act 2003 will take effect later this year, and that appointed water companies have new responsibilities under the Act. WSL 02/05 dated 16 June 2005 announces that the regime will start on 1 December 2005. One of your company's new responsibilities is to prepare an access code on how it will offer to provide access to its water supply system. Your company is required to follow our guidance on access codes and the access code template. The access code must include indicative prices, which we expect your company to publish by 31 August 2005.
Your company should complete its access code and make it publicly available from 15 September 2005. Please arrange to send an electronic and paper copy of your access code to Hayley Purcell at Competition Policy Team, Office of Water Services, Centre City Tower, 7 Hill Street, Birmingham, B5 4UA or e-mail: Hayley.Purcell@ofwat.gsi.gov.uk by that date, or before if possible.
