OFWAT CONSULTS ON CHANGES TO WATER COMPANIES' LICENCES

Ofwat today published for consultation the details of a series of proposed licence modifications to water companies in England and Wales.

The changes, most of which were consulted on previously, include:
  • Simplifying the materiality calculation for interim price reviews;
  • Aligning licences in respect of changes in construction costs; and
  • Altering the treatment of new charges for unoccupied premises.

Ofwat is also seeking views on changes to the substantial effect clause that would restore the balance of risks between customers and companies to that which existed prior to 2000. The proposal would ensure that the provision, previously known as the "shipwreck clause", only applies where a company faces a significant threat to its operating and financial position.

1. The Director General of Water Services is the economic regulator of the water and sewerage companies in England and Wales. He exercises his powers in a way that he judges will allow them to carry out their functions properly, and finance them. WaterVoice represents customers' interests.

4. In PN 43/03, dated 5 November 2003, Ofwat stated that it would be consulting on the substantial effect licence provision.
5. A number of the proposed licence modifications were consulted on by Ofwat in MD 174 (dated 20/12/01), MD 181 (dated 3/10/02), and 'Setting price limits for 2005-10: Framework and approach' (published October 2002).
