WATER ACT 2003: SELF-LAY AND REQUISITIONING

The Water Act 2003 received Royal Assent on 20 November 2003. The Act will amend the provisions of the 1991 Water Industry Act that relate to installing new water mains, service pipes and sewers and create new provisions relating to lateral drains. The new provisions in the Act will increase choice and clarity for water companies and developers, hopefully leading to improved efficiency and keener prices. We will also have powers to consider disputes about the terms and conditions of self-lay and requisitioning disputes.

These new provisions will come into force in spring 2004. To ensure these are workable and operate well, the industry needs to be involved in the detailed development of the new regime, building on its expertise and experience. The attached paper sets out in more detail how we will engage key stakeholders in the implementation process. It includes information about the consultation papers that we will be issuing, the workshops that we are holding and the work of the self-lay group.

We want to work closely with the industry over the next five months to deliver an effective new regime.
