CONSULTATIONS: FINANCIAL ARRANGEMENTS FOR SELF-LAY AND REQUISITIONING AGREEMENTS AND PROCESS FOR HANDLING DISPUTES AND APPEALS
The Water Act 2003 received Royal Assent on 20 November. The Act amends the provisions of the Water Industry Act 1991 that relate to installing new water mains, service pipes and sewers and creates new provisions relating to lateral drains. We now want to consult on aspects of the new regime.
I enclose copies of our consultation papers. These outline the financial principles we will apply in determining disputes and the process for handling disputes under the new legislation. We welcome your comments on these. Please reply by 12 March 2004. Our final guidance papers will be published in spring 2004 around the time that the new regime will start. We would be grateful for early responses, which will help us to finalise the guidance paper as soon as possible. Please note, we will place all responses in our library unless these are marked as confidential.
We are holding a seminar on 20 January 2004 at Austin Court, Birmingham, when we will discuss issues arising from the paper. You are invited to come. This will be an opportunity for you to discuss your point of view. Please return the attached form by 9 January 2004 if you would like to attend or send a representative. We will then send further details. Please note that we may need to restrict attendance.
We are also circulating this paper to other stakeholders including regulators, developers and self-lay organisations.
