WSL 5/04 21 December 2004
Dear Colleague
WATER ACT 2003: WATER SUPPLY LICENSING CONSULTATIONS:
- NEW CONDITIONS OF APPOINTMENT/LICENCE CONDITIONS FOR WATER SUPPLY LICENSEES
- EXCEPTIONS REGULATIONS AND EXEMPTIONS
You might recall from my letter of 26 February 2004 (WSL 01/04) that we consulted on our policy proposals on "Modifications to water undertakers' existing conditions of appointment and conditions of Water Supply Licences". I am grateful for your responses.
In that consultation we noted that we would consult on the legal text of the new water supply licence conditions and appointment conditions later in 2004. We have considered respondents' comments on our policy proposals and additional issues raised since the February consultation. Our conclusions on policy and the proposed legal text of the new conditions are set out in the attached consultation paper. I welcome your views on them.
We are also consulting on our proposed exceptions from the water supply prohibitions under the Water Industry Act 1991 (as amended by Water Act 2003) and how the Secretary of State or Welsh Assembly Government will grant, revoke or withdraw an exemption. I welcome your views on our proposals.
Please send your comments by 22 March 2005 on the consultations to Hayley Purcell at Office of Water Services, Centre City Tower, 7 Hill Street, Birmingham, B5 4UA. You may also email your responses to hayley.purcell@ofwat.gsi.gov.uk. Please respond by 22 March 2005.
Unless otherwise requested, we will put all responses in the Ofwat library and make them available to the public.
Yours sincerely
Tony Smith
Director of Competition and Consumer Affairs
